The international community began to assist Bosnia-Herzegovina, Croatia and Serbia during post-conflict reconstruction and to supply justice mechanisms in various ways. This PhD project studies the role of criminal law in reconstructing social order in Bosnia-Herzegovina, Croatia and Serbia. The three levels of war crime prosecution - at the ICTY, the War Crimes Chambers, and lower level domestic courts - will be subject of various examinations. Compliance of domestic courts with international criminal law standards as set out by the ICTY jurisprudence will be one aspect; the examination of domestic trials with regard to newly introduced common law aspects will be another. Additionally, the new mediation laws and their implementation in the respective countries will be reviewed with regard to criminal procedures. The overall aim is to analyze the three levels at which war crime trials are taking place with regard to their differences/similarities.
